PRIVACY POLICY

DIGITiQ APP

Effective Date October 3, 2023

This policy describes how Vehicle Service Group (“VSG”) collects and uses personal information collected from technicians  (“Data”) on the DIGITiQ app (“App”). Technicians, or workshop personnel, are referred to in this Policy as the “Users.” On the App is a Rotary tool (the “Tool”).

Customer information that Users may submit on the App is subject to the Privacy Policy available at each auto shop where the technicians using the App are employed. This policy does not describe those information collection and use practices. It also does not apply to information collected through other means, including on the VSG website.


NOTICE AT COLLECTION

1. The Personal Information We Collect and How We Collect It

For the purpose of using some features (e.g. report of the operations carried out using the product) the User can input Data. The categories of Data about Users that are collected on the app are: User name, email address, and company name.

We collect information directly from technicians. We also collect information passively. This includes through common tracking tools. We may also get information from third parties. This includes information from technicians’ employers, confirming their employment status.

We do not use or disclose technicians’ sensitive personal information, as defined by California law, for inferring characteristics or for purposes other than those permitted by law.

2. How We Use Technician Information

Technician information collected on the App is used to assist in the delivery of services. It is also used to communicate with technicians and for app maintenance and support. It will also be used to prevent fraud, and for complying with our legal obligations. We will also use information as permitted or as we notify you.

4. DATA DISCLOSURE TO THIRD PARTIES – RECIPIENTS OF THE DATA

We may disclose technicians’ information to third parties. This includes technicians’ employers. It also includes our related entities or service providers who do work for us. We may also disclose information if we believe we are required to comply with law or with government authorities. We will also do this to protect ourselves, our users, or the safety of others.

5. TRANSFER OF PERSONAL DATA TO THIRD COUNTRIES OR INTERNATIONAL ORGANISATIONS

Data will be processed both in EU territories by the Processor, TEXA SpA, and in the USA, Canada and Mexico.

6. PERIOD FOR WHICH THE DATA WILL BE STORED

Data will be kept for so long as necessary to provide the services, except in cases whose retention is required by laws, regulations or provisions issued by the Authorities.

7. RIGHTS OF THE DATA SUBJECTS

Users in certain jurisdictions, including the EU, UK and California, have certain rights. This includes the following:

  • right to access their Data and information about processing;
  • to rectify Data if inaccurate or incomplete
  • right to erasure of their Data;
  • to restriction of processing;
  • to Data portability in a structured, commonly used and machine-readable format;
  • to object to processing;
  • not to be subject to a decision based solely on automated processing; and
  • if the Data processing is based on consent, the right to withdraw consent (without prejudice to the lawfulness of processing performed before the withdrawal).

For California residents, we will not discriminate or retaliate against you because you have exercised your rights under California law.  If you are in the EU, if you believe your rights have been harmed, you can lodge a complaint with a data protection authority or regulator.

Under California law we are required to tell Californians if we “sell” or “share” information as those terms are defined by applicable law. Sell is defined as disclosing personal information to a third party for monetary or other valuable consideration. Share means sharing personal information with a third party for cross-context behavioral advertising. For Technicians, we do not do sell or share Data based on our understanding of those terms.

8. UPDATES

From time to time, we may update this Policy. The updated Policy will be made available on our App or as we may notify you if required by law. If you continue to use the App after the Policy is posted, that signifies your acceptance of that change.
